4 Good Reasons You Should NOT Be Your Own Registered Agent
Appointing yourself registered agent for your company sounds like the right thing to do when in fact it is exactly the opposite! It might seem as if it would be less expensive and simpler just to be your own registered agent, but there are several reasons why this is not a good idea.
What Is a Registered Agent?
A Florida registered agent can be either a business entity or an individual that agrees to accept service of process and official mail for corporations, LLCs and other entities registered in Florida.
1. The agent needs to have a physical address.
In accordance with state law, a Florida registered agent must have a physical street location in the state, called a registered office, where certified mail can be reliably delivered during regular business hours. There has to be a physical building where a process server can physically go to deliver service of process or accept delivered certified mail.
2. You may not want to use your home address.
If you plan on being your own registered agent, you may end up having to use your home address, which will make the address public. As the registered agent for your business, your name and address are public information. Also, a process server could come to your home to serve you with notice of a lawsuit, something you may not want to deal with. With us you will never run the risk of your customers, vendors, or neighbors seeing a process server deliver legal documents to your place of business or home.
3. Agents are required to keep regular business hours.
Registered agents need to have regular business hours to accept service of process. This can be difficult for small business owners who often cannot stay in an office all day and who cannot afford to hire full-time employees to work out of a specific location. You authorize us to receive service of process and legal documents of any kind (“Legal Documents”) on your behalf. Registered agent services are limited to the receipt of service of process as well as the receipt and forwarding of Legal Documents, and do not include the receipt of any general or regular mail or other items. Accordingly, we do not assume liability to you, or any third party, for loss of mail or other items which are not Legal Documents.
